CJ Gertrude Torkornoo Files Supreme Court Injunction Against Presidential Impeachment Committee

The suspended Chief Justice of the Republic of Ghana, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkornoo, has filed a motion for interlocutory injunction at the Supreme Court, seeking to stop a presidential committee from proceeding with its inquiry into petitions for her removal.

Filed under Suit No. J8/113/2025, the case names the Attorney-General and five others as defendants: Justice Gabriel Scott Pwamang, Justice Samuel Kwame Adibu-Asiedu, Daniel Yao Domelevo, Major Flora Bazwaanura Dalugo, and Professor James Sefah Dzisah.

The suspended Chief Justice is being represented by Godfred Yeboah Dame, former Attorney-General and head of Dame & Partners Unlimited.


Chief Justice Seeks Four Critical Orders

The motion, filed at the Supreme Court Registry in Accra at 3:00 PM on May 21, 2025, is scheduled for hearing at 9:00 AM. Justice Torkornoo is requesting the following orders from the Court:

  1. Restraint of the Committee – An order to restrain the committee made up of the 2nd to 6th defendants from proceeding with any inquiry, implementing their terms of reference, or taking action based on the prima facie case until the Supreme Court rules on the matter.

  2. Recusal of Justices Pwamang and Adibu-Asiedu – An order restraining the two sitting Supreme Court justices from participating or presiding over the committee proceedings.

  3. Suspension of Presidential Warrant – An order suspending the President’s warrant for the Chief Justice’s suspension, issued under Article 146(10) of the 1992 Constitution, until the court reaches a final determination.

  4. Further Orders – Any additional orders the Court deems appropriate.
